Minor Driving Licence Rules India (16-18 Age)

Can a 16-year-old hold a driving licence in India? Only under one narrow condition: a gearless scooter or moped with an engine under 50cc, and only with written parental consent. The Motor Vehicles Act 1988 and the 2019 Amendment Act treat minor driving as a serious offence elsewhere, with steep fines on the guardian and the vehicle owner. What the Law Says

Section 4 of the Motor Vehicles Act 1988 lays down age limits for different vehicles:

  • 16 to under-18 years: may hold an LL or DL only for a motor cycle without gear with engine capacity not exceeding 50cc
  • 18 years and above: eligible for geared motorcycle (MCWG) and LMV (car)
  • 20 years and above: eligible for transport (commercial) classes
  • Under 16 years: no driving licence at all, no exceptions

The 2019 Amendment Act made underage driving a much more serious offence. Section 199A holds the parent or guardian responsible, with fines of approximately Rs 25,000 and penalty under MV Act up to 3 years if a minor under 16 drives any motor vehicle.

Eligibility for 16 to 17 Age

A 16-year-old can apply for a learner's licence under tight conditions:

  • Age: minimum 16 years; check actual age, not academic class
  • Vehicle: gearless scooter or moped under 50cc only
  • Parental consent: written, signed by father, mother, or legal guardian
  • Eyesight: basic vision check at RTO
  • Address proof: Aadhaar, school transfer certificate, parent's Aadhaar with applicant name
  • School enrollment: some states ask for current school certificate
  • Form 1: self-declaration of physical fitness

How to Apply for Minor LL

  1. Open Sarathi Parivahan: Visit sarathi.parivahan.gov.in. Pick your state.
  2. Click Apply for Learner Licence: Select the gearless scooter class (typically MCWOG or 50cc category).
  3. Aadhaar e-KYC: Use the applicant's Aadhaar for OTP verification.
  4. Fill Form 2: Add personal details, parent's name, parent's Aadhaar, address.
  5. Upload parental consent letter: Scanned copy signed by parent or guardian.
  6. Upload age and address proof: Plus three photos and signature.
  7. Pay LL fee: Approximately Rs 200 to Rs 300 via UPI or net banking.
  8. Book LL test slot: Visit RTO for biometric verification and the 10-question online test.
  9. Pass the test: Same as adult LL test; 6 of 10 questions correct to pass. LL is issued same day.

Vehicles a Minor Can Drive

Only gearless scooters and mopeds with engine capacity at or below 50cc are permitted for 16 to 17-year-olds. Examples:

  • Honda Activa 6G: Note: this is 110cc, NOT permitted for under-18
  • Permitted 50cc range: TVS XL100 (loosely classed), older Luna mopeds, electric scooters with under-50cc equivalent power
  • Electric scooters: e-scooters with low-speed (under 25 km/h) and motor power under 250W are exempt from licence requirement entirely; check state classification
Most Modern Scooters Are 100cc Plus

The Honda Activa, TVS Jupiter, Suzuki Access, and most popular Indian scooters are 100cc to 125cc. They are NOT eligible for a minor learner's licence. Riding them as an under-18 is illegal and attracts a Rs 25,000 fine on the guardian under Section 199A.

Graduating at Age 18

The day you turn 18, you become eligible for a regular LL and DL. The minor LL does NOT auto-convert; you apply for the adult licence as a fresh case.

  1. Wait till your 18th birthday: date of birth on Aadhaar is checked automatically
  2. Apply for fresh LL on Sarathi: choose MCWG (geared motorcycle), LMV (car), or both
  3. Submit fresh documents: most documents stay the same; parental consent is no longer needed
  4. Take new LL test: fresh 10-question theory test
  5. Take driving test after 30 days: book practical test slot
  6. Surrender minor LL (optional): most RTOs auto-archive minor LL once adult DL is issued

If a minor (under 18 in most cases, or 16-17 driving above 50cc) is at the wheel during an accident, motor insurance providers can deny the entire claim. The guardian and the vehicle owner also face fines under Section 199A and Section 180 of the MV Act. Never let a minor drive a geared two-wheeler or any car, even on private property.
